Goals and activities

The project “Improving the capacities of inspections, misdemeanor courts and businesses” supported by the MATRA Fund for regional partnership of the Embassy of the Netherlands is implemented for the purpose of improving the inspection-misdemeanor actions by providing support for the implementation of plea agreement for admitting to misdemeanors and proving violations in the field of inspection oversight.

By ensuring adequate capacities and facilitating knowledge transfer, this project creates the conditions to harmonize the actions of both sides - inspection, which submits the request and represents the prosecution, and misdemeanor courts - which leads to shorter procedures and saving of resources among businesses, courts and inspections, as well as an increase of responsibilities of all participants.

The key activity of this project is the introduction and implementation of the plea agreement for admitting to violations under jurisdiction of the Market inspection, Labor inspection and Agriculture inspection. By drafting guidelines for implementing plea agreements under the jurisdiction of the three mentioned inspections, and facilitating workshops and direct communication, NALED provides continuous expert support to inspectors for more efficient inspection oversight.

Within the scope of the project, NALED produced 18 guidelines adopted by the Coordination Commission for Inspection Oversight:

  • The general guidelines (expert-methodological explanations) for the application of plea agreement for admitting to violations in the area of inspection oversight
  • Greater number of special guidelines (expert-methodological explanations) for the application of plea agreement for admitting to violations governed by special laws/regulations
  • Expert-methodological explanations for proving misdemeanors in the area of inspection oversight:
  • Explanations on misdemeanor liability of legal entities, entrepreneurs and responsible persons (22nd session)
  • Guidelines for the application of disguised purchase method in inspection oversight (26th session)
